GENERAL FLIGHT CONDITIONS

1. Subject of the contract

3-Parts is a virtual airport, which is a platform that connects people with the same lifestyle.

The flight contract is concluded between 3-Parts AG and the passenger.

The languages are german and english.

2. Booking conditions

a) Booking conditions

Persons who wish to become a passenger with 3-Parts must meet the following conditions. By submitting the booking form, individuals confirm:

  • that they are a natural person who is at least 18 years old
  • that they are legally authorized to enter into a binding contract with 3-Parts
  • that they are not on any list of persons prohibited from doing business with the United States (e.g., the U.S. Treasury Department's list of "Specially Designated Nationals" or any similar government agency list), nor are they facing any other similar prohibition
  • that they are not legally prohibited from using the services
  • that they have not committed, and have not been prosecuted or convicted of, any crime or offense, including a sex crime, involving the use or threat of violence against persons, animals or property
  • that they are not listed as a sex offender on any state, federal or local sex offender registry
  • that they have not been removed from the Services in the past unless they have express written permission to enter into a new flight contract to conclude

b) Reporting obligation

The passenger is obliged to inform 3-Parts immediately if he does not or no longer meets a requirement under 6a). 3-Parts reserves the right to deactivate the passenger account immediately if there is suspicion that the traveler does not or no longer meets a requirement. If a booking requirement was not present from the start or is no longer met, the flight contract is not valid or becomes invalid.

3. Conclusion of the flight contract

The flight contract is concluded through application and acceptance. Submitting the booking form constitutes an application. Once 3-Parts has sent the flight ticket, the flight contract is concluded through acceptance.

The prices for the flight ticket depend on the class booked. The current prices can be found on the homepage. Prices are based on supply and demand.

3-Parts is not obliged to accept a person and may refuse them without giving reasons.

4. The passenger

A passenger is a person who books a flight and receives the flight ticket.

3-Parts enters the country and state or canton into the passenger profile based on the information provided in the booking form.

If any information on the booking form changes, such as first name, last name, street, house number, city, state, country, email address, cell phone number or nationality according to passport or ID, the traveler is obliged to inform 3-Parts in writing by email.

5. Singles, friends and couples

Passengers indicate in their profile whether they are traveling as a single, friend or couple. The details can be changed freely.

Singles are single people who want to meet other singles. Friends are single people or people in a relationship who want more friends. Couples are people in relationships who want to meet other couples for friendship.

The rule is that people with the same needs write to each other, i.e. singles contact singles, friends write to friends and couples meet couples.

It is not permitted to pretend to be single if you are in a relationship and it is not permitted to pretend to be a couple if you are single. It is also not permitted to pretend to be a friend and look for sexual contacts.

6. Private purposes

Singles, friends and couples arrange to meet for private purposes, to spend their free time or vacation together. For example, they might meet to go for drinks or meals, to play a sport together or to attend an event together.

A violation of this article occurs when people register with 3-Parts for business reasons or to advertise. This list is not exhaustive. All flight bookings made for reasons other than private purposes are prohibited.

7. The classes

a) General

People book an economy class, business class, first class or private jet flight. Economy class means that the passenger leads a modest life, business class an upscale life, first class a luxurious life and private jet a high-end life.

  • Economy Class passengers have access to the airplane.
  • Business Class passengers have access to the airplane and business class lounge.
  • First Class passengers have access to the airplane and first class lounge.
  • Private jet passengers have access to the private jet and private jet lounge.

b) Violation

A violation of this article occurs when a person chooses a class that does not correspond to his or her lifestyle. This is for example the case, if a class is only chosen for financial reasons by passengers.

8. Change of class

3-Parts assumes that passengers are aware of their lifestyle. Therefore, it is generally not possible to change classes between Economy Class, Business Class, First Class and Private Jet. An exception is made if the passenger's lifestyle changes permanently due to an unforeseeable event such as winning the lottery, inheriting money or getting divorced, resulting in a clearly different, new lifestyle. The change of class must be applied for in writing and must be justified. When upgrading to a higher class, the passenger must pay the difference in price. When downgrading to a lower class, the difference in price will be refunded by 3-Parts. There is no right to a change of class.

9. Parties

3-Parts organizes parties for first class and private jet passengers. The parties take place for first class passengers from Europe in Europe, from Asia in Asia, from Australia in Australia, from Africa in Africa and from America in America. Private jet passengers are invited to the parties on every continent.

3-Parts records the events with photo and videos and may publish them for advertising purposes on the homepage, LinkedIn, Facebook, Instagram 3parts_onecircle or in other social media. The passenger hereby authorizes that he or she may be photographed and filmed and that any photos and videos in which he or she is depicted may be published in public. The rights belong to 3-Parts.

The passengers from the first class and private jet are together at the parties. 3-Parts is free to organize the parties, how often and in which country and locations they take place. There is no right to the organization of a party.

Participation in the parties is free. The right to charge an entrance fee for the party remains reserved.

10. Flight miles

Passengers receive 10% of the flight ticket price as flight miles. These are credits in euro. With each new flight ticket, passengers collect more flight miles. Passengers can choose to use their flight miles to purchase a discounted flight ticket for a family member or friend or donate them to the 3-Parts Foundation, which helps institutions in need.

It is not permitted to use flight miles to purchase another discounted flight ticket for yourself.

11. Airplanes, Business Class Lounge, First Class Lounge, Private Jets and Private Jet Lounge

Airplanes and private jets unite people who live in the same country. The Business Class Lounge and First Class Lounge connect people who live on the same continent, so in Europe, Asia, Australia, Africa or America. The Private Jet Lounge bring together people from all over the world.

The airplanes, business class lounges, first class lounges, private jets and private jet lounge are groups or so-called spaces in which passengers post about their free time and vacations, discuss common interests and organize public or private meetings. See also article 15 section 5 of the general flight conditions.

The passenger name can be chosen freely. Men and women are mixed and the profiles are visible to each other.

12. Prohibited actions

a) Prohibited actions

It is not permitted

  • use other passengers' data for commercial or unlawful purposes or disseminate it without their consent
  • disclose private or proprietary information that the passenger is not authorized to disclose
  • solicit money or other items of value from other passengers, whether as a gift, loan or in the form of remuneration
  • use our services for fraud, pyramid schemes or other similar practices
  • use our services in relation to the financing of political campaigns or for the purpose of influencing elections
  • violate applicable laws, including but not limited to data protection laws, intellectual property laws, anti-spam laws, criminal laws, privacy laws, public laws, narcotics laws, drug laws and regulatory requirements and use our services for harmful, illegal or abusive purposes, in particular for use in money laundering or other financial crimes
  • use the services in any way that interferes with, harms or negatively impacts the services, the platform, the networks and IT infrastructure used to operate the services and the platform, or other passengers
  • use any robot, crawler, website search/retrieval application, proxy or other manual or automatic device, method or process to access, retrieve, index, “data mine” or in any way duplicate or circumvent the navigational structure or presentation of our Services or its content
  • upload viruses or other malicious code or otherwise jeopardize the security of our services
  • “frame” or ‘mirror’ any part of our Services without the prior written permission of 3-Parts
  • modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble our services, in whole or in part, or cause others to do so
  • use or develop third-party applications or services that interact directly with our services or member content or information without our written consent, including artificial intelligence or machine learning systems
  • investigate, scan or test the vulnerability of our services or any system or network
  • encourage, promote or participate in activities that violate this flight contract

b) Consequences of a violation

If actions take place that are prohibited under this article, the flight contract will be terminated without notice. The prohibited activities will be deleted. 3-Parts may, at its own discretion, determine whether the activities qualify under this article. The right to file a criminal complaint remains reserved.

13. Prohibited content

a) against the purpose of the contract

Passengers are expressly prohibited from posting content that violates the purpose of the contract. This includes, among other things, commercial content, political campaigns, appeals for donations, advertising and spam, soliciting money, gifts or loans, escort services, demanding money for meetings or parties, advertising meetings and seeking flings and affairs. This list is not exhaustive. All content that violates the contractual purpose of 3-Parts is prohibited.

b) against applicable constitutions, laws, regulations, guidelines, morals and ethics and common sense

Passengers are expressly prohibited from posting content that violates applicable constitutions, laws, regulations, guidelines, morals and ethics and common sense. 3-Parts prohibits posts with the following content:

  • is likely to be considered offensive or is intended to harass, upset, embarrass, alarm or annoy another person
  • is obscene, pornographic, violent, contains nudity or is otherwise offensive to human dignity
  • is abusive, offensive or threatening, discriminatory or promotes or encourages racism, sexism, hatred or intolerance
  • promotes or facilitates illegal activities, including but not limited to terrorism or incitement to hatred, or the mere submission of which constitutes a criminal offense
  • promotes or facilitates activities that may result in harm to passengers or third parties, including but not limited to the promotion of self-harm, eating disorders, dangerous challenges, violent extremism
  • are defamatory, libelous or untrue
  • are associated with commercial activities, including but not limited to sales, contests, promotions and advertising, promotion of services, links to other websites or premium hotline telephone numbers
  • involve the transmission of spam or malicious software
  • contain spyware, adware, viruses, corrupted files, worm programs or other malicious code that disrupts, destroys or restricts the functionality of any software, hardware, telecommunications, networks, servers or other devices, Trojan horses or other material designed to damage, interfere with, falsely intercept or expropriate data or personal information, whether from 3-Parts or otherwise
  • violates the rights of third parties, including but not limited to intellectual property rights and privacy rights
  • was not created or automatically generated by you
  • contain the image or likeness of another person without that person's consent, or in the case of a minor, the consent of the parent or legal guardian, or contain an image or likeness of a minor who is not depicted with his or her parent or legal guardian
  • are incompatible with the intended use of the Services

This list is not exhaustive. The posting and sharing of any content that violates applicable constitutions, laws, regulations, guidelines, morals and ethics and common sense is prohibited.

c) Consequences of a violation

Posting or sharing content that violates this article may result in the deletion of the prohibited content, immediate deactivation of the passenger account and termination of the flight contract without notice. 3-Parts may determine at its own discretion whether content qualifies as prohibited content. The right to file criminal charges remains reserved.

14. Rules of conduct

3-Parts has separate rules of conduct, these are guidelines, on how passengers should behave in the virtual airport. The principles of honesty and respect apply. The rules of conduct must also be read, understood, and accepted.

15. Content from the passenger

Content from the passenger is content that the passenger posts and shares themselves. The passenger is responsible for their content. It is prohibited to post and share content that is not intended for other passengers, that violates the general flight conditions, the rules of conduct, the data protection regulations and applicable laws and guidelines.

The passenger is solely responsible and liable for his/her content and agrees to indemnify, defend, hold harmless and defend 3-Parts in respect of any claims made in connection with his/her content.

The passenger represents and warrants to 3-Parts that the information they provide on the platform or to 3-Parts is accurate, including any information provided through other third party sources.

The content on the social network should be relevant to the intended use of 3-Parts' services. The passenger may not enter any personal contact, bank or peer-to-peer payment data, names, addresses, telephone numbers, e-mail addresses, credit or debit card details and URLs in the social network, regardless of whether this data belongs to the passenger or another person. If the passenger decides to publish or pass on personal data, they do so at their own risk. 3-Parts clearly recommends exercising caution when disclosing personal data on the Internet.

The passenger's posts on the airplane, private jet and in the lounge are visible to passengers on the same airplane, same private jet or in the same lounge. The passenger must therefore ensure that the content they post can be published without hesitation. He confirms and agrees that his content can be viewed by other passengers and that other passengers can pass on his content to third parties regardless of these conditions. By uploading the content, the passenger represents and warrants to 3-Parts that he/she has all necessary corresponding rights and licenses and automatically grants 3-Parts a license to use the content in accordance with Article 19 of the general flight conditions.

The passenger is aware and agrees that 3-Parts monitors and reviews its content and that 3-Parts has the right to remove, delete, edit, restrict, block or prevent access to its content at any time in its sole discretion. Furthermore, the traveler is aware and agrees that 3-Parts is under no obligation to display or review its content

16. Content from other passengers

The passenger has access to, but not ownership of, content from other passengers and therefore may not copy or use it except as provided in these terms.

The passenger should always carefully review passenger content and independently verify its accuracy. Passenger content may contain biased, false, harmful, offensive or misleading information.

The passenger has no rights with regard to content from other passengers and, unless expressly authorized by 3-Parts, may only use content from other passengers to the extent that its use corresponds to the intended purpose of 3-Parts' services, i.e. to enable communication and meetings with other persons. The passenger may not copy, use for commercial purposes, spam, harass or threaten other passengers. The misuse of content from other passengers is prohibited.

17. Contents of 3-Parts

3-Parts is the owner of all other content on our services.

All other text, content, graphics, user interfaces, trademarks, logos, sounds, images, audio recordings, videos, files and other intellectual property appearing on the 3-Parts Services are owned, controlled or licensed by 3-Parts and are protected by copyright, trademark and other intellectual property laws. All rights, title and interest in and to the 3-Parts content shall at all times remain with 3-Parts.

18. Data protection

Data protection describes the protection against the improper processing of personal data and the protection of the right to informational self-determination. 3-Parts has a separate privacy policy, which the passenger must also read, understand and accept.

19. Rights granted by the passenger to 3-Parts

The passenger is the owner of all content that he makes available to 3-Parts, but he also grants 3-Parts the right to use his content as provided for in this flight contract.

By entering into the flight contract, the passenger grants 3-Parts a worldwide, perpetual, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, translate, modify, reformat, incorporate into other works, promote and distribute or otherwise make available to the public all or any portion of its content, including any information that 3-Parts may, with its consent, retrieve from other third party sources, in any format now available or developed in the future. other third party sources, in any format currently available or developed in the future. 3-Parts' license to the passenger's content is not exclusive, but 3-Parts' license to derivative works created through the use of 3-Parts' services is exclusive. For example, 3-Parts has an exclusive license for screenshots of 3-Parts' services that contain the passenger's content.

The passenger agrees that 3-Parts may access, preserve and disclose his/her passenger account information, including his/her content, if required to do so by law or in the good faith belief that such action is reasonably necessary to: i) comply with legal process; ii) enforce these Terms; iii) respond to claims that content violates the rights of third parties, iv) respond to the traveler's customer service requests, v) protect the rights, property or personal safety of the company or any other person, or vi) investigate, prevent or take other action regarding illegal activities, suspected fraud or other wrongdoing.

20. Reporting violations

Passengers must comply with the general flight conditions, the rules of conduct and the privacy policy. 3-Parts requests that passengers report a violation to info@3-parts.com. The report will always be treated confidentially. Reporting helps to stop harmful and inappropriate behavior and protect others. Possible measures include a warning, temporary deactivation of the account until the situation has been clarified, permanent deactivation of the account and termination with or without notice.

As set forth in the privacy policy, 3-Parts may disclose passenger safety information and take necessary action if 3-Parts believes the passenger has violated the terms, including prohibiting the use of 3-Parts' services. The passenger understands and agrees that 3-Parts may not disclose any information to the passenger if this would compromise the safety or privacy of other passengers.

21. Ordinary termination

a) by the passenger

The passenger terminates the flight contract for a flight duration of 12 months with a notice period of 30 days on the last day by email to info@3-parts.com.

Without timely termination, the flight contract is automatically extended for the same flight duration and the amount is due after the notice period has expired. The amount is due immediately. If payment is not made on time, the passenger's profile will be deactivated after the flight contract expires. The payment obligation remains in place and reminder fees will be charged. The profile will be reactivated once the invoice has been paid. The flight contract is shortened by the amount of time the passenger is late in paying.

b) by 3-Parts

3-Parts terminates the flight contract for a flight duration of 12 months with a notice period of 30 days on the last day by email. No reason is required for termination.

22. Termination without notice

a) by the passenger

The passenger cancels the flight contract without notice for important reasons or for reasons that make it unreasonable for him to continue to be on the platform. The termination shall be made by e-mail to info@3-parts.com and must be justified.

3-Parts refunds the amount paid on a pro rata basis, the termination without notice is justified.

b) by 3-Parts

3-Parts shall terminate the flight contract without notice in the event of a repeated or serious breach of the general flight conditionseneral, rules of conduct and privacy policy. It is at the discretion of 3-Parts to decide when a violation is considered repeated and serious. The passenger has 10 days to comment on the termination without notice. After this time, the termination is deemed to have been accepted and the account will be irrevocably deleted. The amount will not be refunded.

23. Deletion of the passenger account

After the regular cancellation period has expired or after a justified cancellation without notice, 3-Parts deletes the passenger's account. When the account is deleted, the profile and all activities on the airplane, business class lounge, first class lounge, private jet and private jet lounge disappear. The passenger can also delete his account himself at any time. However, the obligation to give timely written notice of cancellation still applies.

24. Liability of the Passenger

The passenger is solely liable for his/her conduct, actions and content and confirms to indemnify, defend, hold harmless and indemnify 3-Parts in respect of all claims asserted in connection with his/her conduct, actions and content.

25. Exclusion of liability

3-Parts assumes no liability for damages incurred by the passenger due to technical malfunctions, force majeure, violations of the general flight conditions, privacy policy and the rules of conduct and improper use of the platform. This includes, for example, false information in the profiles, false posts, dubious meetings, disrespectful and unlawful behavior by passengers and hacker attacks.

3-Parts provides the platform on an “as is” basis. 3-Parts cannot give any assurances about the content or function of the services. In particular, 3-Parts provides no warranty, guarantee or liability with regard to the number of passengers, the accuracy of the information provided by passengers, the availability of the platform and the confidentiality of the content shared between passengers. 3-Parts does not guarantee that people from every continent and from every country are passengers on 3-Parts. 3-Parts disclaims any warranty, guarantee or liability with regard to the content distributed via the platform and services. 3-Parts does not guarantee that the platform will function without interruption, that there will be a minimum number of travelers in the airplane, private jet and lounges, that the travelers will meet singles, friends or couples and that the travelers will comply with the provisions of this agreement, the privacy policy and the rules of conduct.

3-Parts, its employees and licensors assume no liability for indirect and consequential damages, including loss of profit, loss of data, loss of use of the platform or immaterial losses resulting from technical malfunctions, use of the platform, violation of individual provisions of this contract, conduct in dealing with passengers, violation of third party rights, violation of applicable laws, rights and regulations, platform manipulation, hacker attacks or cybercrime.

26. Modifications

3-Parts reserves the right to change the general flight conditions at any time. Passengers will be notified of changes to the general flight conditions in an appropriate manner, in particular by e-mail or through the platform. The amended general flight conditions shall enter into force upon publication and shall be deemed tacitly accepted by the continued use of the platform. Passengers are therefore advised to regularly check the homepage for updates to the general flight conditions.

The further development of our services is an ongoing process. We therefore also reserve the right to change, modify, supplement or discontinue the services we offer, the associated content and the scope of functionalities at our discretion and without prior notice. This flexibility enables us to react promptly to technological developments and user needs and to continuously improve the quality of our services.

27. Severability clause

Should any provision of these general flight conditions be or become invalid or void, this shall not affect the validity of the remaining provisions of these general flight conditions. Invalid or void provisions shall be replaced by valid provisions that come closest to their economic purpose. The same procedure shall apply if there is a gap in the regulations or if a provision of these general flight conditions proves to be unenforceable.

28. Applicable law

These general flight conditions are subject to Swiss substantive law to the exclusion of the Swiss Federal Act on Private International Law (IPRG) and the UN Convention on Contracts for the International Sale of Goods (CISG).

29. Place of jurisdiction

The ordinary courts in 8810 Horgen, Switzerland shall have exclusive jurisdiction for all disputes or claims arising from or in connection with these general terms and conditions of flight, including their validity, invalidity, breach or termination. Notwithstanding this, 3-Parts is entitled to sue passengers at their place of residence. Mandatory places of jurisdiction in accordance with applicable law remain reserved.
