GENERAL FLIGHT CONDITIONS

1. Subject of the contract

3-Parts is a social network that connects people with the same lifestyle.

The passengers meet for private purposes, that is to spend free time and vacations with a partner or new friends.

The flight contract is concluded between 3-Parts, Seestrasse 155a, 8802 Kilchberg, Switzerland and the passenger.

2. Booking requirements

a) Booking requirements

A person meets the following conditions when booking a virtual flight. The requirements must be met throughout the entire flight duration.

When a traveler submits the booking form, he confirms that he

  • is a natural person
  • is at least 18 years old
  • is of sound mind
  • holds a valid passport or ID
  • is legally authorized to enter into a binding flight contract with 3-Parts
  • is legally authorized to use 3-Parts
  • has not committed any crime or offense against persons, animals, or property and has not been prosecuted or convicted for such
  • is not listed as a sex offender in any state, federal, or local sex offender registry
  • is not on a list of individuals prohibited from doing business with the United States (e.g., on the "Specially Designed Nationals" list of the U.S. Department of the Treasury or a similar list from government agencies), nor is he facing any other similar prohibition

b) Reporting obligation

The passenger is obliged to inform 3-Parts immediately if he does not or no longer meets a requirement under 2a). 3-Parts reserves the right to deactivate the profile immediately if there is suspicion that the passenger does not or no longer meets a requirement. If a booking requirement was not present from the start or is no longer met, the flight contract is not valid or becomes invalid.

3. Conclusion of the flight contract

The flight contract is concluded through offer and acceptance. If the traveler sends the booking form, this is considered an application. If 3-Parts sends the traveler the flight ticket, this is considered acceptance and the flight contract is concluded.

3-Parts decides which traveler it sends a flight ticket to.

5. The passenger

A passenger is a person who has the passenger name and password for check-in.

3-Parts enters the country and state into the profile based on the information provided in the booking form.

If any information on the booking form changes, such as first name, last name, street, house number, city, state, country, e-mail address, cell phone number or nationality, the passenger is required to notify 3-Parts via e-mail.

6. The virtual airport

a) Departures

3-Parts offers virtual flights from Europe, Asia, Oceania, Africa and America.

3-Parts follows the official travel advice and offers virtual flights from safe countries.

3-Parts is free to decide from which countries virtual flights are offered.

Homepage and virtual airport are in the global aviation language English.

b) Flight

An airplane and a private jet unite passengers who live in the same country, such as in Switzerland, Germany or Austria. Business Class Lounge and First Class Lounge connect passengers from the same continent, such as from Europe, Asia, Oceania, Africa or America. Private Jet Lounge brings together passengers from the 5 continents.

Airplanes, Business Class Lounge, First Class Lounge, private Jets and Private Jet Lounge are social networks. Passengers post about their hobbies and interests and meet to spend free time together and go on vacations.

A passenger becomes visible when they post in the airplane, Business Class Lounge, First Class Lounge, private jet or Private Jet Lounge.

Passengers see posts in the airplane, Business Class Lounge, First Class Lounge, private jet and Private Jet Lounge from passengers from the same airplane, Business Class Lounge, First Class Lounge, private jet or Private Jet Lounge.

c) Travel destination

Passengers indicate in their profile whether they are traveling as a single, friend or couple. Singles are looking for other singles. Friends are singles or passengers in relationships who wish to have more friends. Couples want to meet other couples for friendships.

Passengers with the same travel destination converse, meaning singles write to singles, friends contact friends and couples meet couples.

7. Classes

a) Definition and rights

Economy Class, Business Class, First Class and Private Jet symbolize the lifestyle of the passengers, that means whether they make their daily decisions based on function and purpose, quality, reputation and name, or status.

Economy Class means modest lifestyle, Business Class elegant lifestyle, First Class luxurious lifestyle and Private Jet ultra luxurious lifestyle.

An Economy Class flight ticket includes

  • access to the virtual airplane

A Business Class flight ticket includes

  • access to the virtual airplane
  • access to the virtual Business Class Lounge

A First Class flight ticket includes

  • access to the virtual airplane
  • access to the virtual First Class Lounge

A Private Jet flight ticket includes

  • access to the virtual private jet
  • access to the virtual Private Jet Lounge

b) Change of class

3-Parts assumes that passengers are aware of their lifestyle. Therefore, it is generally not possible to change classes between Economy Class, Business Class, First Class and Private Jet. An exception is when the passenger's lifestyle changes permanently due to an unforeseen event such as a lottery win, inheritance or divorce, leading to a distinctly different, lasting lifestyle. The change of class must be requested and justified via e-mail. In the case of a switch to a higher class, the passenger must pay the price difference proportionally. In the case of a switch to a lower class, 3-Parts refunds the price difference proportionally.

8. Rules of conduct

The passengers behave respectfully, which means they are honest and considerate.

They provide truthful information in their profile, whether about their CV, education, profession, family circumstances or future plans. The passengers look in the photos and videos as they do in reality. Posts, such as photos, videos, audio recordings and comments, are consistent with the lifestyle. Posts generated with AI must be labeled as such.

The passengers behave considerately, meaning that in the photos and videos, they are well groomed, appropriately dressed and depicted in an esthetic and peaceful environment. They post actively, like the passengers' posts and post factual, positive and empathetic comments. Private messages are decent and unobtrusive. Meetings are arranged in safe places.

9. Prohibited actions

a) Prohibited actions

It is not allowed

  • to use data from other passengers for commercial or unlawful purposes or to disseminate it without their consent.
  • to disclose private or protected information to which the passenger is not entitled.
  • to ask other passengers for money or other valuables, whether as a gift, loan or in the form of compensation.
  • to use our services for fraud, pyramid schemes or other similar practices.
  • to use our services in relation to the financing of political campaigns or for the purpose of influencing elections.
  • to violate applicable laws, including but not limited to data protection laws, intellectual property protection laws, anti-spam laws, criminal laws, privacy laws, public law, drug laws and regulatory requirements, or to use our services for harmful, illegal or abusive purposes, particularly for money laundering or other financial crimes.
  • to use the services in a manner that obstructs, damages or negatively impacts the services, the platform, the networks and IT infrastructure used to operate the services and the platform or other passengers.
  • to use robots, crawlers, web search/research applications, proxies or other manual or automatic devices, methods or processes to access, retrieve, index, "data-mine," or in any way reproduce or circumvent the navigation structure or presentation of our services or their content.
  • to upload viruses or any other malicious code or otherwise compromise the security of our services.
  • to "frame" or "mirror" parts of our services without the prior written consent of 3-Parts.
  • to modify, adapt, sublicense, translate, sell, reverse engineer, decrypt, decompile or otherwise disassemble our services in whole or in part or to induce others to do so.
  • to use or develop third party applications or services that interact directly with our services or the content or information of passengers without our written consent, including artificial intelligence or machine learning systems.
  • to investigate, scan or test the vulnerability of our services or any system or network.
  • to favor, promote or participate in activities that violate this flight contract.

b) Consequences of a violation

If actions take place that are prohibited under this article, the flight will be canceled without notice. 3-Parts can determine at their own discretion whether the activities qualify under this article. A criminal complaint is reserved.

10. Prohibited content

a) Against the purpose of the contract

Passengers are expressly prohibited from posting content that violates the purpose of the contract. This includes, among other things, business content, political actions, fundraising appeals, advertising and spam, soliciting money, gifts or loans, escort services and much more. This list is not exhaustive. All content that violates the contractual purpose of 3-Parts is prohibited.

b) Against applicable constitutions, laws, regulations, guidelines, morals and ethics and common sense

Passengers are expressly prohibited from posting content that violates applicable constitutions, laws, regulations, guidelines, morals and ethics, and common sense.

3-Parts prohibits posts with the following content

  • Deception or misrepresentation, including catfishing, that is creating an online persona that is not the passenger
  • Nudity, sexually explicit or vulgar content, pornography or the commercial exchange of romantic or sexual activities
  • Sexual exploitation or abuse of children and adolescents
  • Purchase, sale or mediation of illegal drugs, drug paraphernalia or abuse of legal substances
  • Promotion or support of violent, dangerous or terrorist agendas
  • Hatred and discrimination based on characteristics such as race, nationality, caste, gender, sexual orientation, disability or religion
  • Dissemination of demonstrably false or misleading content that could cause serious harm or endanger public safety
  • Psychological or sexual violence as well as sexual harassment and bullying
  • Fraud or theft aimed at deceiving users for financial or material gain
  • Promotion or glorification of suicide, self-harm, eating disorders or distorted body image
  • Violent, graphic or bloody content, including descriptions of violence, realistic blood or weapons
  • Platform manipulation, such as artificial influence on connections, conversations or activities through automation or scripts

3-Parts prohibits posts

  • that are likely to be considered offensive or intended to harass, upset, embarrass, alarm or annoy others.
  • that are obscene, pornographic or violent or otherwise violate human dignity.
  • that are abusive, offensive or threatening.
  • that promote or enable illegal activities, including but not limited to terrorism or incitement to hatred or the mere submission of which constitutes a criminal offense.
  • that promote or enable activities that cause harm to passengers or third parties, including but not limited to dangerous challenges and violent extremism.
  • that are defamatory, slanderous or untrue.
  • that are associated with commercial activities, including but not limited to sales, competitions, promotions and advertising, the promotion of services, links to other websites or phone numbers for premium hotlines.
  • that involve the transmission of spam or harmful software.
  • that contain spyware, adware, viruses, corrupt files, worms or other malicious code that disrupts, destroys or restricts the functionality of software, hardware, telecommunications, networks, servers or other devices, trojans or other material intended to damage, disrupt, intercept or expropriate data or personal data, whether from 3-Parts or otherwise.
  • that violate the rights of third parties, including but not limited to intellectual property rights and data protection rights.
  • that were not created by you or automatically generated.
  • that contain the image or likeness of another person without the consent of that person or in the case of a minor, the consent of the parent or guardian or an image or likeness of a minor that is not depicted together with their parent or guardian.
  • that are not in line with the intended use of the services.

c) Consequences of a violation

Posting or sharing content that violates this article will result in the removal of the prohibited content and immediate cancelation of the flight. 3-Parts determines at its own discretion whether content qualifies as prohibited content. A criminal complaint is reserved.

11. Content from the passenger

Content from the passenger is content that the passenger posts and shares themselves. The passenger is responsible for their content. It is prohibited to post and share content that is not intended for other passengers, that violates the general flight conditions, privacy policy, criminal law and other applicable laws and guidelines.

The passenger is solely responsible and liable for his content and agrees to indemnify, defend, hold harmless and defend 3-Parts in respect of any claims made in connection with his content.

The passenger represents and warrants to 3-Parts that the information they provide to 3-Parts and in the virtual airport is accurate, including any information provided through other third party sources.

The content in the virtual airport must be relevant to the intended use of 3-Parts services. The passenger may not enter any personal contact, bank or peer-to-peer payment data, names, addresses, telephone numbers, e-mail addresses, credit or debit card details and URLs in the virtual airport, regardless of whether this data belongs to the passenger or another person. If the passenger decides to publish or pass on personal data, they do so at their own risk. 3-Parts clearly recommends exercising caution when disclosing personal data on the Internet.

The passenger must ensure that the content they post can be published without hesitation. He confirms and agrees that his content can be viewed by other passengers and that other passengers can pass on his content to third parties regardless of these conditions. By uploading the content, the passenger represents and warrants to 3-Parts that he has all necessary corresponding rights and licenses and automatically grants 3-Parts a license to use the content in accordance with Article 15 of the general flight conditions.

The passenger is aware and agrees that 3-Parts monitors and reviews its content and that 3-Parts has the right to remove, delete, edit, restrict, block or prevent access to its content at any time in its sole discretion. Furthermore, the traveler is aware and agrees that 3-Parts is under no obligation to display or review its content

12. Content from other passengers

The passenger has access to content from other passengers, but not ownership of it and may therefore neither copy nor use it, except as provided in these terms.

The passenger must always carefully review the contents of passengers and independently verify their accuracy. Contents from passengers may contain false, misleading, harmful or disrespectful information.

The passenger has no rights regarding the content of other passengers and may only use the content of other passengers to like and comment on it, unless expressly authorized by 3-Parts. The traveler may not copy content from other passengers, use it for commercial purposes, spam or to harass or threaten other passengers. The misuse of content from other passengers is prohibited.

13. Contents of 3-Parts

3-Parts is the owner of all other content on the homepage, in the virtual airport and on our services.

All other text, content, graphics, user interfaces, trademarks, logos, sounds, images, audio recordings, videos, files and other intellectual property appearing on the 3-Parts services are owned, controlled or licensed by 3-Parts and are protected by copyright, trademark and other intellectual property laws. All rights, titles and claims to the content of 3-Parts remain with 3-Parts at all times.

14. Data protection

Data protection describes the protection against the improper processing of personal data and the protection of the right to informational self determination. 3-Parts has a separate privacy policy, which the passenger must also read, understand and accept.

15. Rights granted by the passenger to 3-Parts

The passenger owns all the content they provide to 3-Parts, but they give 3-Parts the right to use their content as provided in these general flight conditions.

By entering into the flight contract, the passenger grants 3-Parts a worldwide, perpetual, transferable, sublicensable, royalty free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, translate, modify, reformat, incorporate into other works, promote and distribute or otherwise make available to the public all or any portion of its content, including any information that 3-Parts may, with its consent, retrieve from other third party sources, in any format now available or developed in the future. other third party sources, in any format currently available or developed in the future. 3-Parts license to the passenger's content is not exclusive, but 3-Parts license to derivative works created through the use of 3-Parts services is exclusive. For example, 3-Parts has an exclusive license for screenshots of 3-Parts services that contain the passenger's content.

The passenger agrees that 3-Parts may access, preserve and disclose his personal information, profile information, posts, including his content, if required to do so by law or in the good faith belief that such action is reasonably necessary to: i) comply with legal process; ii) enforce these Terms; iii) respond to claims that content violates the rights of third parties, iv) respond to the traveler's customer service requests, v) protect the rights, property or personal safety of the company or any other person, or vi) investigate, prevent or take other action regarding illegal activities, suspected fraud or other wrongdoing.

16. Reporting violations

Passengers must comply with general flight conditions and the privacy policy. 3-Parts requests that passengers report a violation at info@3-parts.com. The report will be treated confidentially. The report helps to stop disrespectful and harmful behavior and to protect other passengers. Possible measures include a warning, temporary deactivation of the profile until the situation is clarified and ordinary or immediate cancellation of the flight.

As stated in the privacy policy, 3-Parts may share data for the safety of passengers and take necessary measures if 3-Parts believes that the passenger has violated the general flight conditions, including the prohibition of using 3-Parts services. The passenger understands and agrees that 3-Parts may not disclose information to them if it compromises the safety or privacy of other passengers.

17. Ordinary cancellation

a) by the passenger

The passenger cancels the flight with a duration of 6 months and a cancellation period of 10 days on the last day of the flight contract via e-mail to info@3-parts.com.

Without timely cancellation, the flight will automatically be extended by the same flight duration and the amount will be due after the cancellation period has expired. Without timely payment, the passenger's profile will be deactivated after the flight. The payment obligation remains in effect and reminder fees will be charged. The profile will be reactivated once the invoice is settled. The flight is shortened by the time the passenger pays late.

b) through 3-Parts

3-Parts cancels the flight with a duration of 6 months and a cancellation period of 10 days on the last day of the flight contract via e-mail. The cancellation is valid without a reason.

18. Immediate cancellation

a) by the passenger

The passenger cancels the flight without notice due to important reasons or reasons that make it unreasonable for them to remain at the virtual airport. The cancellation must be made via e-mail to info@3-parts.com and must be justified. 3-Parts has 10 days to respond to the immediate cancellation. Without a timely response, the cancellation is considered accepted. Otherwise, the immediate cancellation only becomes legally effective once it is confirmed by 3-Parts. If the passenger does not agree with the decision of 3-Parts, they have the option to pursue legal action.

3-Parts refunds the paid amount proportionally, the immediate cancellation is justified.

b) through 3-Parts

3-Parts cancels the flight without notice in the event of a repeated or serious violation of the general flight conditions or privacy policy via e-mail. When a violation is considered repeated and severe is at the discretion of 3-Parts. The passenger has 10 days to respond to the immediate cancellation. Without a timely response, the cancellation is considered accepted. If the passenger's statement proves to be untrustworthy, incomprehensible, unlawful or unfounded, 3-Parts confirms the immediate termination. If the passenger does not agree with the decision of 3-Parts, they have the option to take legal action.

The amount will not be refunded.

19. Deletion of the profile

After the ordinary cancellation period has expired or after a justified termination without notice, 3-Parts deletes the passenger's profile. With the deletion, the profile information and all activities in the airplane, Business Class Lounge, First Class Lounge, private jet and Private Jet Lounge disappear. The passenger can also delete his profile himself at any time. The obligation to give ordinary notice of termination still remains.

20. Liability of the Passenger

The passenger is solely liable for his/her conduct, actions and content and confirms to indemnify, defend, hold harmless and indemnify 3-Parts in respect of all claims asserted in connection with his/her conduct, actions and content.

21. Exclusion of liability

3-Parts assumes no liability for damages caused to the passenger by force majeure, technical malfunctions, hacker attacks and violations of general flight conditions and the privacy policy.

3-Parts provides the virtual airport without any warranty. 3-Parts does not provide any warranty, guaranty or liability in particular regarding the technical availability of the virtual airport, that the virtual airport will operate continuously without technical issues, that passengers from every continent and every country are present and that a minimum number of passengers are in the airplanes, Business Class Lounge, First Class Lounge, private jets and Private Jet Lounge, that passengers have booked a flight in their correct class, that travelers find a partner or new friends and that travelers comply with the general flight conditions and privacy policy.

3-Parts, its employees and licensors are not liable for indirect damages and consequential damages, including lost profits, data losses, lost use of the virtual airport or intangible losses resulting from technical disruptions, the use of the virtual airport, violation of the general flight conditions and privacy policy, violation of applicable laws, rights and regulations, platform manipulation, hacking attacks or cybercrime.

22. Adjustments

3-Parts has the right to adjust the general flight conditions at any time. The adjustments will be communicated to passengers via email. The adjusted general flight conditions come into effect once published on the homepage and are considered implicitly accepted through continued use of the virtual airport.

The development of our services is an ongoing process. We reserve the right to change, modify, supplement or discontinue the services we offer, the associated content and the scope of functionalities at our discretion and without prior notice. This flexibility allows us to respond to technological developments and the needs of passengers.

23. Salvatory clause

If a provision of these general flight conditions is invalid or void, the other provisions are not affected. Invalid or void provisions will be replaced by valid provisions that come closest to their economic purpose. The same applies if there is a gap in the regulations or if a provision of these general flight conditions proves to be unenforceable.

24. Applicable law

The general flight conditions are subject to substantive Swiss law, excluding the Federal Act on Private International Law (IPRG) and the UN Convention on Contracts for the International Sale of Goods (CISG).

25. Jurisdiction

The ordinary courts in 8810 Horgen, Switzerland have exclusive jurisdiction over any dispute or claim arising out of or relating to the general flight conditions, including their validity, invalidity, violation or dissolution. Departing from this, 3-Parts is entitled to take action against passengers at their place of residence. Reservations remain mandatory jurisdictions under applicable law.

26. Other

3-Parts is a public limited company in formation. With entry in the commercial register, the new contractual partner is 3-Parts AG and the legal relationships are transferred to the public limited company.
